Business Terms & Conditions

 

All Fuse Clothing orders that are made for the products we sell – including (but not limited to) printed t-shirts and items on sale on this site– are subject to terms and conditions. These terms are in existence to protect both parties and by placing an order with us, you are understood to have viewed, reviewed and accepted the following terms and conditions of sale.

 

 


 

 

1.0 The Contract Between Us

 

1.1 As Fuse Clothing do not offer credit in any form, we must receive payment in full for the price of the goods that you order before your order can be accepted.

 

1.2 Once payment has been received by Fuse Clothing we will confirm that your order can be accepted by sending an email to you at the email address you provide when placing your order.

 

1.3 Our acceptance of your order brings into existence a legally binding contract between us.

 

 

2.0 Price and Title

 

2.1 Unless otherwise agreed between us in writing, the price(s) payable for goods that you order are set out clearly on the Fuse Clothing website at the date and time of your order.

 

2.2 Unless otherwise stated, the price(s) displayed on our website is exclusive of any value added tax, and unless otherwise mentioned all costs or charges in relation to packaging, loading, unloading, carriage and insurance are included within the price which is due for payment when placing your order.

 

2.3 Where applicable delivery charges are clearly set out at fuse-clothing.com

 

2.4 It might not be possible for us to deliver to all UK locations.

 

2.5 If you qualify for a discount or have a special promotional code applicable to the price of the goods, you will pay the discounted price. The discounted price will exclude any applicable VAT.

 

2.6 The goods remain the property of Fuse Clothing until they have been paid for in full.

 

 

3.0 Payment

 

3.1 Unless we agree a different way of payment, all payments must be made online using PayPal or credit / debit card and you should pay for the goods by PayPal balance, credit or debit card prior to packing, dispatch or delivery of your order.

 

3.2 Payment of the price for the goods is due in pounds sterling as stated on the Fuse Clothing website. Other currencies may be accepted as detailed on our website wherever applicable.

 

3.3 No payment shall be deemed to have been received until we have received cleared funds and written payment receipt confirmation from our chosen online payment processing gateway. Fuse Clothing shall not be held responsible for any delays in payment processing due to issues or matters outside our reasonable control.

 

3.4 You shall make all payments due under this agreement in full without any deduction whether by way of set-off, counterclaim, discount, abatement or otherwise unless you have a valid court order requiring an amount equal to such.

3.5 Should your cleared payment be of a value lower to the total value of the product(s) you have ordered, we will not process your order in accordance with clause 1.1 until full cleared payment has been received.

 

 

4.0 Cancellation of Your Contract by US

 

4.1 Fuse Clothing reserve the right to cancel the contract between us if:

 

4.1.1 We have insufficient stock or are unable to fulfil your order or are unable to deliver the goods you have ordered for reasons beyond our reasonable control.

 

4.1.2 We do not deliver to your geographical location; or

 

4.1.3 One or more of the goods you ordered was listed as an incorrect description, specification or price due to a typographical error or an error in the pricing information received by us from our suppliers.

 

4.2 If we do cancel your contract we will notify you by email and will recredit your original payment less any applicable costs, fees or relevant deductions via the original payment method as soon as possible but in any event within 30 days of the date of your order. We will not be obliged to offer any additional compensation for dissapointment and/or inconvenience suffered.

 

 

5.0 Delivery & Returns
 

5.1 We will deliver the goods ordered by you to the delivery address you state for delivery at the time you make your order. If you do not provide an alternative delivery address, your order will be delivered to the billing address provided at the time you place the order.

 

5.2 All Fuse Clothing sales are final. Exchanges will be given up to 7 days from when the product was received. Upon the return, a credit note will be given, of which shipping costs are not applicable, and no refunds are accepted. Orders must be fully reviewed before finalising as one the order is confimed it cannot be changed.

 

5.3 Some geographical locations will incur an additional delivery fee. Such remote and / or distant UK destinations (including but not limited to Northern Ireland, the Isle of Man, the Scilly and Channel Islands and certain parts of Scotland, such as the Highlands) shall as a result incur an additional charge. An additional postal charge quotation for such location(s) can be provided upon request. Should we offer free delivery and/or an all-inclusive price that includes the cost of delivery, we reserve the right to charge an additional fee for this service. 5.4 We are unable to guarantee delivery within our standard, published timescales to remote and / or rural areas.

 

5.5 Subject to clause 2.6 above, you will become the owner of the Fuse Clothing goods you have ordered when they have been delivered to you. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction howsoever caused.

 

5.6 Stated turnaround is measured in working days, defined as days Monday, Tuesday, Wednesday, Thursday and Friday and are days on which the clearing banks in the City of London are open for normal business.

 

5.7 Delivery information is based on best estimates and are not, unless otherwise stated, guaranteed. We cannot be held responsible for delays to dispatch and/or delivery outside of our control or that of our carefully selected delivery partners.

 

5.8 As we use external third party couriers, in circumstances where such couriers encounter delivery issues or delays, we cannot be held responsible for any such issues arising, Fuse Clothing will not be obliged to offer any additional compensation for any loss or consequential loss – be that financial or otherwise – as a result of a failure by any named courier to complete the delivery of your order.

 

5.9 Unfortunately, we are unable to deliver to PO Boxes or BFPO addresses.

 

5.10 All Fuse Clothing sales are final, exchanges can be given (of which delivery charges are not applicable) up to 7 working days after delivery and must adhere to the following: when trying on items of clothing, please ensure that you are not wearing make-up, perfume/aftershave or deodorant which may leave a scent or marks on the item. We will be unable to accept return of any item where there is evidence that these instructions have not been followed. Items must be in perfect original sale-able condition. Tags must not be broken.

 

If you require a different item then you will need to place a new order online and return the original item for a refund. Returns postage charges are non-refundable, you must include you’re bank account number and bank sort code on the returns form for a refund to be achievable. It is not up to Fuse Clothing to contact you for these details.

 

5.11 Each delivered item is checked before delivery for quality purposes. However if the item you received is faulty or not what you originally ordered, a return form will be completed and return to the address provided. If a fault occurs with a delivered item clause 5.10 will still apply. The garments must not be tampered with in any way, if Fuse Clothing feel the item has been worn or deliberately tampered with in any way we can reserve the right to reject refund requests. Fuse Clothing will not be held responsible for items that have been washed incorrectly. However it is imperative that each individual garment’s washing instructions are adhered to exactly as stated on our ‘Garment Care & Printing’ page on the Fuse Clothing website. Each garment is wash-tested thoroughly and quality-checked on each production batch prior to leaving the supplier. We cannot accept returns that have been soiled, torn or damaged due to incorrect washing or use.

 

 

6.0 Limitation of Liability

 

6.1 If the goods we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us in writing at our contact address of the issue within 5 working days of the delivery of the goods in question. No liability is accepted for any defect resulting from fair wear and tear, wilful damage, fire, water or liquid damage.

 

6.2 If you notify a problem to us under this condition, our only obligation will be, at your option:

 

6.2.1 to make good any shortage or non-delivery;

 

6.2.2 to replace or repair the exact same Fuse Clothing product that is damaged or defective; or

 

6.2.3 to provide you with a credit note.

 

6.3 Save as precluded by law, Fuse Clothing will not be liable to you for any indirect or consequential loss, damages or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this condition and we shall have no liability to pay any money to you by way of compensation other than to provide with a credit note or exchange the exact item by you for the goods in question under clause 6.2 above.

 

6.4 You must observe and comply with all applicable law regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods. The importation or exportation of certain of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you may purchase.

 

6.5 Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer, under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

 

 

7.0 Notices

 

7.1 Unless otherwise expressly stated within these terms and conditions, all notices from you to us must be in writing and sent to our contact address which is accessible through our contact section on our website and all notices from us to you will be displayed on our website from time to time (applicable if order is placed via website) or sent to the address provided to us with your order. Any changes should be notified to us in writing.

 

 

8.0 Force Majeure

 

8.1 Fuse Clothing shall have no liability to you from any failure to deliver goods you have ordered or any delay in doing so for any damage or defect to goods delivered that is caused by any event or circumstances beyond our reasonable control including (but not limited to) acts of God, legislation, strikes and other industrial dispute(s), power supply failure, breakdown of systems or network access, war, drought, flood, fire, explosion or accident.

 

 

9.0 Website Terms and Conditions

 

9.1 You acknowledge and agree to be bound by the terms of our website terms and conditions.

 

 

10.0 Discretion

 

10.1 Fuse Clothing have the right to refuse at any time to continue to carry out work for you on giving two days written notice.

 

 

11.0 Third Party Rights

 

11.1 Except for our affiliates, directors, employees or representatives, a person who is not a party to this agreement has no right under UK Contracts (rights of Third Parties) Act 1999 to enforce any term of this agreement but this does not affect any right or remedy of third party that exists or is available apart from that Act.

 

 

12.0 Governing law

 

12.1 The contract between us shall be governed by and interpreted in accordance with English law and the English courts shall have jurisdiction to resolve any disputed between us.

 

 

13.0 General and Entire Agreement

 

13.1 These terms and conditions, together with our current website prices, delivery details, contact details and website terms and conditions, set out the whole of our agreement relating to the supply of goods to you by us. Nothing said by any sales person or customer service representative on the behalf of Fuse Clothing should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods offered for sale by us. Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.

 

13.2 If any provision of the Contract is found by any court, tribunal or administrative body of competent jurisdiction to be wholly or partly illegal, invalid, void, voidable, unenforceable or unreasonable it shall to the extent of such illegality, invalidity, voidness, voidability, unenforceability or unreasonableness be deemed severable and the remaining provisions of the Contract and the remainder of such provision shall continue in full force and effect.

 

13.3 Failure or delay by us in enforcing or partially enforcing any provision of this agreement shall not be construed as a waiver of any of its rights under this agreement.

 

13.4 Any waiver by us of any breach of, or any default under, any provision of this agreement by you shall not be deemed a waiver of any subsequent breach or default and shall in no way affect the other terms of this agreement.

 

 

14.0 Clients Property and Storage

 

14.1 Fuse Clothing will undertake to store all materials and source files both relating to work carried out for you for a maximum of 3 (three) months, after which time they will be disposed of or if they are electronic files, they will be deleted and/or removed our digital retrieval system.

 

14.2 Client’s property and all property supplied to and on behalf of Client shall, whilst in our possession or in transit to or from you is deemed to be at your own risk unless otherwise agreed and you should ensure that the item(s) is insured accordingly.

 

 

15.0 Copyright

 

15.1 Fuse Clothing may use any images provided via social media or in any form, for the purposes of promotion.

 

15.2 The customer shall indemnify and hold Fuse Clothing and its agents and representatives harmless against all claims, demands, actions, costs, expenses (including but not limited to legal costs and disbursements), losses and damages arising from or suffered or incurred by reason of any claim (including but not limited to the defence of such claim) that the reproduction of the materials by Fuse Clothing infringes the intellectual property or other rights of any third party or misuses the confidential information of a third party.

 

 

16.0 Data Protection

 

16.1 By placing an order with Fuse Clohting, the customer consents to its details being passed on to our database for account management, order processing, accounting and marketing purposes.

 

16.2 The details will be kept by us even after the customer’s trading relationship has been completed.

 

16.3 We may use the customer’s details to provide information about goods and services similar to the goods or services provided to the customer previously and any others matters that we consider may be of interest to customers.

 

 

17.0 Variation to Terms and Conditions

 

17.1 These terms and conditions may be amended from time to time.

 

17.2 The latest version of these terms and conditions will be available via the fuse-clothing.com website.

 

 

18.0 Law

 

18.1 These terms and conditions and all other express terms of the contract with customers shall be governed and construed in accordance with English law. English Courts shall have jurisdiction in relation to any matters arising in connection with any contract between Fuse Clothing and the customer into which these terms are incorporated.
